• In any way that violates any applicable laws or regulations.
• Using Output for decisions with legal, financial, medical, or other high-risk consequences without human review or proper validation.
• Inputting or sharing content that violates applicable laws, infringes third-party rights, or breaches these Terms.
• Modifying, copying, distributing, or selling any part of the Services without explicit permission.
• Reverse engineering, decompiling, or attempting to extract source code from the Services.
• Circumventing rate limits, security measures, or other protections in place.
• Using AI Output to develop competing AI models.
• Representing AI Output as human-generated if it was not.
3. Content
• User Content:
• You may provide input to the Services (“Input”) and receive output (“Output”).
• You retain ownership of your Input. Output is licensed to you for personal or business use, subject to these Terms.
• Responsibility for Content:
• You are solely responsible for ensuring that your Input does not violate laws, infringe third-party rights, or breach these Terms.
• Output Accuracy Disclaimer:
• AI Output is probabilistic and may not always be accurate or reliable. Users are strongly encouraged to evaluate Output for accuracy and appropriateness before relying on it.
• Evaluation Responsibility: You agree to review and validate all Output before using it for your specific use case, especially for decisions with legal, financial, or medical implications.
4. Feedback
We welcome your feedback and suggestions about our Services. By submitting feedback, you grant us the right to use it without restriction or compensation.
5. Paid Accounts
• Billing: You agree to provide accurate payment information for any paid subscriptions or credits. Subscriptions renew automatically unless canceled.
• Non-Refundable Payments: Payments for subscriptions or credits are generally non-refundable, except as required by law.
• Auto-Renewal: Subscriptions will auto-renew unless canceled before the renewal date.
• Price Changes: Users will receive notice at least 30 days before any price changes for subscriptions, and users have the right to cancel.
6. Service Modifications and Termination
• Modification: We may modify or discontinue the Services at our discretion, with prior notice for material changes.
• Termination: We reserve the right to suspend or terminate accounts for:
• Violating these Terms or applicable laws.
• Inactivity for more than one year if the account is unpaid.
• Inactive Accounts: Accounts inactive for over a year may be terminated unless they are part of a paid subscription.
7. Intellectual Property
• Platform IP: All intellectual property rights in the Services, including code, models, and designs, belong to Triple Agent.
• Use of Branding: Unauthorized use of our brand, trademarks, and logos is strictly prohibited.
• User License: Users are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
8. Third-Party Services
• Integration: The Services may include integrations with third-party tools or APIs.
• Third-Party Responsibility: Third-party services are subject to their terms, and we are not liable for their actions, reliability, or functionality.
9. Limitations of Liability
• Disclaimer of Warranties: The Services are provided “as is” without warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose.
• Cap on Liability: Our liability is limited to the greater of $100 or the amount you paid for Services in the last 12 months.
• Exclusions: We are not liable for indirect, incidental, or consequential damages, including loss of profits or data.
10. Indemnification
If you use the Services on behalf of a business or organization, you agree to indemnify and hold us harmless against claims, damages, or expenses arising from:
• Your use of the Services.
• Violations of laws, third-party rights, or these Terms.
• Feedback or products you develop using Outputs.
11. Dispute Resolution
• Informal Resolution: We encourage users to contact us first to resolve disputes informally.
• Arbitration: Disputes will be resolved through binding arbitration, except for small claims or injunctive relief requests.
